Thank you for being here. MRSBYVALLE is a faith based brand, and we run it the way we would want to be treated. These terms explain how our store works, what you can expect from us, and what we ask of you. By browsing mrsbyvalle.com or placing an order, you agree to what follows.

These terms are between you and MRSBYVALLE LLC, located in Belleville, New Jersey. Throughout this document, "we," "us," and "our" mean MRSBYVALLE, and "you" means you, the person visiting or buying.

OUR DESIGNS BELONG TO US, AND THIS PART MATTERS

Every design, illustration, phrase, layout, photograph, product image, written description, and piece of original artwork on this site was created by Marisol Valle or created for MRSBYVALLE. All of it is protected by United States copyright and trademark law, and all rights are reserved.

Copyright in these works attaches automatically at the moment of creation under 17 U.S.C. 102. We did not have to ask permission and we do not have to publish a notice for that protection to exist. It exists.

You may not, without our written permission:

Copy, reproduce, screenshot, trace, redraw, or recreate any of our designs.

Sell, print, or manufacture products bearing our designs or any design substantially similar to ours.

Use our images, product photography, or written descriptions in your own listings, advertisements, or social media as though they were yours.

Upload our designs to print on demand platforms, marketplaces, or file sharing sites.

Use automated tools, scrapers, or bots to collect our images or content.

Use our content, designs, or images to train, fine tune, or develop any machine learning or artificial intelligence system.

What you may do. Share our product pages. Post a photo of yourself wearing or using something you bought from us and tag us, we would genuinely love that. Write about us and link back to us. Buying a product from MRSBYVALLE gives you ownership of that physical item. It does not transfer any copyright, license, or right to reproduce the design on it.

The MRSBYVALLE name and logo are our trademarks. Please do not use them in a way that suggests we endorse, sponsor, or are affiliated with something we are not.

We monitor for infringement and we act on it. If you believe someone is using our work without permission, please tell us at mrs@mrsbyvalle.com. We are grateful every time someone does.

2. YOUR CONTENT, IF YOU SHARE IT WITH US

If you post a review, comment, or photo on our site, or tag us in a public post and give us permission to repost, you keep ownership of it. You grant us a non exclusive, royalty free, worldwide license to use, display, and share that content in connection with promoting MRSBYVALLE, with credit to you where we can.

You promise that anything you share is yours to share and does not infringe anyone else's rights.

3. PRODUCTS, COLORS, AND MADE TO ORDER PRODUCTION

Everything we sell is made to order. Nothing is produced until you buy it. Please see our Refund Policy for full details on production times, shipping, and the very limited circumstances in which we can accept a return.

We work hard to show our products accurately, but screens vary. Colors on your monitor or phone may differ slightly from the finished piece. Natural variation in fabric, wood grain, wax, and canvas is part of handmade and made to order work, and small differences are not defects.

Product descriptions, sizes, and specifications are provided in good faith. We reserve the right to correct errors, update descriptions, and change or discontinue products at any time.

4. PRICING AND ORDERS

All prices are in US dollars. We reserve the right to change prices at any time before an order is placed.

We do our best to keep pricing accurate, but if a product is listed at an obviously incorrect price due to a typographical or system error, we may cancel the order and refund you in full rather than fulfill it at the wrong price. We will always tell you if this happens.

We reserve the right to refuse or cancel any order, including orders that appear fraudulent, orders placed for resale, orders with quantities that are unusual for personal use, and orders that we cannot ship to your location. If we cancel, you get a full refund.

5. SHIPPING

We ship to the United States and Canada only. United States shipping is $6.99 flat rate and free on orders over $100. Canadian shipping is $30 flat rate with 7 to 14 business day transit, and free shipping does not apply to Canada. Full details are in our Refund Policy.

Risk of loss passes to you when the carrier confirms delivery. Our handling of lost and stolen packages is described in the Refund Policy.

6. HOW TO TREAT THIS SITE

Please use mrsbyvalle.com for what it is, a place to read, shop, and be encouraged. Please do not attempt to gain unauthorized access to any part of the site, our accounts, or our systems. Please do not introduce viruses, malware, or any harmful code. Please do not scrape, harvest, or mine data from the site. Please do not interfere with the site's operation or place unreasonable load on it. Please do not use the site for any unlawful purpose, or to harass, threaten, or defame anyone. Please do not impersonate MRSBYVALLE or any other person. Please do not submit false or fraudulent orders, or make fraudulent claims of damage, defect, or non delivery.

We may suspend or block access to anyone who does these things.

7. COPYRIGHT COMPLAINTS

We respect intellectual property and we expect the same. If you believe material on our site infringes your copyright, send a written notice to mrs@mrsbyvalle.com including your physical or electronic signature, identification of the copyrighted work you claim was infringed, identification of the material on our site you claim is infringing with enough detail for us to find it, your name, address, telephone number, and email address, a statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law, and a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

We will respond promptly and will remove material where appropriate. We may terminate the accounts of repeat infringers.

8. THIRD PARTY LINKS AND SERVICES

Our site may link to other websites and may use third party services for payments, shipping, email, and production. We are not responsible for the content, policies, or practices of third parties. Payments are processed by Shopify and its payment partners under their own terms and privacy practices.

9. WARRANTIES

We stand behind the quality of what we make. If an item reaches you damaged or defective, our Refund Policy tells you exactly how we fix it.

Beyond that, the site and everything on it are provided on an "as is" and "as available" basis. To the fullest extent permitted by New Jersey law, we disclaim implied warranties of merchantability and fitness for a particular purpose with respect to the site itself. We do not warrant that the site will be uninterrupted, error free, or free of harmful components.

Nothing in these terms limits or waives any right you have under the New Jersey Consumer Fraud Act, N.J.S.A. 56:8-1 et seq., or any other right that cannot lawfully be waived under New Jersey or federal law. Where New Jersey law does not permit a limitation or disclaimer stated here, that limitation does not apply to you in New Jersey.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by New Jersey law, our total liability to you for any claim arising out of your use of this site or any product you purchase is limited to the amount you actually paid for the order that gave rise to the claim.

We are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost data, or business interruption.

This section does not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that New Jersey law does not permit us to limit. Those limitations do not apply to you in New Jersey.

11. PRODUCT SAFETY

Please burn our candles safely. Never leave a burning candle unattended, keep it away from children, pets, drafts, and anything flammable, place it on a heat resistant surface, trim the wick to one quarter inch before each burn, and never burn for more than four hours at a time. Discontinue use when one half inch of wax remains. Follow the safety information printed on the product.

Our written and spoken content, including books and devotional material, is offered for encouragement and inspiration. It is not medical, legal, financial, or professional advice, and it is not a substitute for care from a qualified professional.

12. GOVERNING LAW AND WHERE DISPUTES ARE RESOLVED

These terms are governed by the laws of the State of New Jersey, without regard to its conflict of law rules.

Any dispute arising out of these terms or your use of this site will be brought exclusively in the state or federal courts located in Essex County, New Jersey, and you and we both consent to the jurisdiction of those courts. If you are a consumer, this does not take away any right you have to bring a claim in small claims court, or any right you have under the consumer protection laws of the state where you live.

13. CHANGES TO THESE TERMS

We may update these terms from time to time. The version posted on this page at the moment you place an order is the version that applies to that order. The date below will always tell you when we last made a change.

14. IF PART OF THESE TERMS CANNOT BE ENFORCED

If a court decides that any provision of these terms is unenforceable under New Jersey law, that specific provision will be modified to the minimum extent necessary or removed, and the rest of these terms will remain in full effect.
